Terms of Service

1. Agreement and eligibility

1.1 These Terms are a binding agreement between you and Jauntabout. You accept them by creating an account, subscribing, claiming a token, or using the service.

1.2 You must be at least 18 years old to use Jauntabout. You represent that the date of birth you provide is truthful and accurate.

1.3 If you receive tokens from another guest, claiming them requires acceptance of these Terms.

2. What is Jauntabout?

2.1 Jauntabout is a planning tool for downtime activities. For each request ("click") we deliver up to three curated itineraries of real-world places and activities matched to your time window, budget, location, and selected vibe.

2.2 Jauntabout is an information and recommendation service only. We do not own, operate, control, inspect, or supervise any venue, event, or activity we recommend. We are not a travel agency, tour operator, ticket seller, restaurant, or event organizer.

2.3 Venues, event organizers, and vendors are independent third parties. They are not our agents, employees, or partners.

3. Venues

3.1 We verify information about venues (hours, prices, availability) against available sources when we build your itinerary. Venues still close, sell out, change prices, and change details without notice. Actual conditions may differ from what the app shows. Use your own judgment before and during any visit.

3.2 We cannot and do not vet venues for safety. Including a location in an itinerary is not a representation that the place, its neighborhood, its patrons, or the route to it is safe, lawful to visit, or suitable for you or your party. It is not an endorsement.

3.3 Assumption of risk. Going out carries inherent risks, including traffic, weather, criminal acts of third parties, unsafe premises, food-borne illness, and injury. You assume all risks arising from visiting any place or attending any activity found through Jauntabout, and from traveling to, between, and from them. Jauntabout does not assume responsibility for any injury, death, illness, loss, or property damage arising from your visits.

3.4 Suggested sequences, travel estimates, and walking distances are planning aids. They are not navigation or safety advice.

3.5 You are solely responsible for confirming that any location may lawfully be entered. A listing does not imply permission to enter.

3.6 If you encounter a dangerous or misrepresented venue, report it in the app. We may remove venues from future itineraries but are not obligated to monitor any venue.

4. Accuracy of information

4.1 We work to include only current, verified information. We do not warrant that any hours, price, availability, description, or other venue information is accurate, complete, or current, and we are not liable for errors in that information or for your reliance on it.

4.2 If a delivered itinerary set contains zero itineraries, you are not charged a token (Section 8.4). This is your remedy for a failed generation.

5. Age-restricted venues and alcohol

5.1 Providing a false date of birth, or false age information for anyone in your party, is a material breach of these Terms and may result in immediate account termination.

5.2 Every venue is solely responsible for enforcing its own age restrictions, including checking identification and refusing service. Our filter is not an age-verification system and does not replace venue carding. We are not liable for any venue's decision to admit, refuse, or serve any person.

6. Food preferences and allergies

6.1 While we do our best to honor your food preferences, we cannot and do not warrant any venue's claims about their cooking practices or adherence to dietary laws or restrictions. It is your responsibility to make sure you are comfortable with a restaurant's adherence to your needs.

6.2 We cannot and do not warrant that any venue's offerings are free of any allergen or ingredient. Kitchens cross-contaminate and menus change. If you or anyone in your party has a food allergy, confirm directly with the venue before ordering. Do not rely on Jauntabout's filters for any medical or allergy decision.

7. Bookings, tickets, and external links

7.1 Your contract is always with the ticket provider or venue. When you reserve, book, or buy a ticket for any venue, event, or experience found through Jauntabout, whether through an external link or through a purchase completed inside Jauntabout, your contract is directly with the venue, organizer, or vendor ("Supplier"), not with us. Jauntabout is not the seller, organizer, merchant, or provider of any venue, event, or experience. Suppliers are independent third parties, not our agents or employees (except as narrowly stated in 7.4).

7.2 Suppliers are solely responsible for their venues, events, and services, including descriptions, pricing, availability, admission, age and ID enforcement, safety, quality, and legal compliance. The Supplier's own terms and policies govern your transaction.

7.3 Refunds, cancellations, and event changes are the Supplier's responsibility and are governed by the Supplier's own policy. We may relay refund requests or information as a courtesy but have no obligation or authority to grant refunds on a Supplier's behalf.

7.4 When Jauntabout collects payment for a Supplier's ticket or reservation, it acts solely as the Supplier's limited payment collection agent. Your payment to Jauntabout satisfies your payment obligation to the Supplier. Our collection of it does not make us the seller of, a party to, or a guarantor of the underlying ticket, reservation, event, or experience.

7.5 When you book or buy for your party, you represent that everyone attending meets the Supplier's age requirements. The Supplier remains solely responsible for verification and admission (Section 5).

7.6 Jauntabout itself sells no tickets and takes no reservations. Where booking happens on the Supplier's or a vendor's own site, we link you there. A link is provided for convenience and is not an endorsement of any Supplier, site, or vendor.

7.7 Affiliate commissions. Some booking links are affiliate links: if you buy through one, the vendor may pay Jauntabout a commission. You pay the same price either way. Your purchase is still between you and the Supplier (Section 7.1).

8. Subscriptions, billing, and tokens

Jauntabout monthly subscriptions provide limited access to our itinerary services. The unit of access is called a token. Each token is single use, and can be used to create up to three itineraries for a given outing.

8.1 Subscriptions are sold and billed on our website (https://jauntabout.app/account) through our payment processor, Stripe. Current tiers, prices, and monthly token allowances are shown at checkout. We never sell subscriptions or tokens inside the mobile app.

8.2 Automatic renewal. Subscriptions renew monthly at the disclosed price until you cancel. You will be asked for separate, affirmative consent to the renewal terms at checkout. You can cancel at any time online, through the same account portal where you subscribed, effective at the end of the current billing period.

8.3 Tokens. Each billing cycle adds your tier's token allowance to your account. Unused tokens roll over, subject to a cap of three times your tier's monthly allowance. Tokens above the cap are not added. Saved tokens are never taken away.

8.4 Spending. One token is spent per click, before itineraries are revealed. If generation returns zero itineraries, no token is spent.

8.5 Tokens never expire and are never forfeited. Your saved tokens remain fully usable if you cancel your subscription.

8.6 Tokens are redeemable only in the Jauntabout app, and for cash only where the law requires.

8.7 Transfers. You may gift tokens to anyone by sharing a claim code. You may not sell, trade, or exchange tokens or claim codes for money or anything of value. Transfers are free, are final when claimed, and move tokens without creating or destroying value. We may void claim codes, reverse transfers, and suspend accounts involved in fraud or in the sale or attempted sale of tokens.

8.8 Anti-fraud. We may suspend redemption or transfer of specific tokens, or specific accounts, while we investigate fraud, theft, or abuse. We will not use this right to expire or forfeit tokens held in good faith.

8.9 Chargebacks. If a payment that funded tokens is reversed, we may remove the corresponding tokens, wherever they sit, and recover value already redeemed.

8.10 We reserve the right to change our subscription prices at any time. You will be notified before your renewal. Price changes never apply retroactively to existing tokens.

9. Referral and ambassador programs

9.1 Reward programs, including referral rewards and the ambassador program, are governed by their own program terms, which supplement these Terms.

10. AI in the service

10.1 Jauntabout uses artificial intelligence to select possible events, and to arrange the final selection of your three itineraries. The AI selects and arranges only from place, time, price, and availability data our systems have already gathered and verified. It cannot invent places or details.

10.2 Itineraries are suggestions for leisure planning. They are not professional, medical, safety, or travel advice.

11. Acceptable use

Do not: misrepresent your age or identity; scrape, resell, or harvest the service or its data; reverse engineer the apps; probe or breach security; use the service to harass, stalk, or track any person; interfere with other guests' use; or use the service for any unlawful purpose. We may suspend or terminate accounts for any reason, and we may seek to recover damages your misconduct at a venue causes Jauntabout or its reputation. Your tokens remain redeemable except to the extent they were fraudulently obtained.

12. Intellectual property

The service, app, site, brand, and our content are owned by Jauntabout or our licensors and protected by law. Venue information is drawn from licensed third-party sources and public data and belongs to its owners. We grant you a personal, non-transferable, revocable license to use the apps and service for personal, non-commercial purposes.

13. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL INFORMATION IN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING. WITHOUT LIMITING SECTION 3, WE DO NOT WARRANT THAT ITINERARIES OR VENUE INFORMATION WILL BE ACCURATE, COMPLETE, CURRENT, SAFE, OR SUITABLE FOR YOU.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) JAUNTABOUT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (ii) ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITS; THOSE LAWS PREVAIL WHERE THEY APPLY. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

15. Release (venue disputes)

If you have a dispute with any venue, vendor, event organizer, or other guest, you release Jauntabout from claims, demands, and damages of every kind arising out of or connected with that dispute, including claims relating to personal injury, illness, or property damage occurring at or because of a venue. If you are a California resident, you waive California Civil Code §1542 ("A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that if known by him or her would have materially affected his or her settlement with the debtor or released party.").

16. Indemnification

You will indemnify and hold Jauntabout harmless from third-party claims arising out of your content, your violation of these Terms, your violation of law, or your dealings with venues, vendors, or other guests.

17. Disputes: informal resolution first, then individual arbitration

17.1 Talk to us first. Before filing any claim, email support@jauntabout.app with your name, account, and a description. Both sides will try in good faith to resolve the dispute informally for 45 days.

17.2 Binding individual arbitration. Unresolved disputes will be finally resolved by binding arbitration before [NAM / AAA] under its consumer rules, on an individual basis, under the Federal Arbitration Act. Either side may instead bring an individual claim in small-claims court, and either side may seek injunctive relief in court for IP infringement or misuse of the service.

17.3 Class action waiver. CLAIMS PROCEED ONLY ON AN INDIVIDUAL BASIS. NO CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTIONS, AND NO CLASS-WIDE ARBITRATION.

17.4 30-day opt-out. You may opt out of arbitration (not the rest of these Terms) by written notice to support@jauntabout.app within 30 days of first accepting these Terms.

17.5 Arbitration fees follow the provider's consumer rules. We will pay the filing and arbitrator fees the rules assign to us.

18. Governing law

These Terms are governed by the laws of Washington, excluding its conflicts rules, subject to the FAA for Section 17. Venue for non-arbitrable court actions: Clark County, Washington.

19. App stores

The apps are distributed through the Apple App Store and Google Play under their standard license terms. Apple and Google are not parties to these Terms, are not responsible for the service, and have no warranty, support, or product-liability obligations for Jauntabout. Purchases are never made through the app stores (Section 8.1).

20. Changes, termination, and general

20.1 We may update these Terms. Material changes take effect no sooner than [30] days after notice (in-app or email), except changes required by law. Continued use after the effective date is acceptance. Changes never retroactively expire or forfeit saved tokens.

20.2 You may close your account at any time. Sections 8.5 through 8.7 (token survivability) and 13 through 18 survive.

20.3 Severability; no waiver by inaction. You may not assign these Terms; we may assign to a successor. These Terms plus program terms and the Privacy Policy are the entire agreement.
